By accessing or using the website www.pomonafencebuilder.com (the "Site") or by engaging GC Pomona Fence Builder ("Company," "we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or engage our services.
GC Pomona Fence Builder provides residential and commercial fence installation, repair, replacement, and related services in Pomona, CA and surrounding areas. Services are performed in accordance with the scope agreed upon in writing between the Company and the customer prior to work beginning.
We reserve the right to decline any project at our discretion. Services are subject to availability and scheduling.
We offer free on-site estimates. An estimate is a good-faith approximation of project cost based on information available at the time of inspection. Estimates are not guaranteed final prices.
Final pricing is confirmed in a written proposal or contract before work begins. Changes to project scope after a contract is signed may result in additional charges, which will be communicated to the customer in writing before proceeding.
We are not responsible for price differences resulting from changes in material costs, unforeseen site conditions, or changes in project scope requested by the customer.
Project start dates are estimates and may change due to weather, material availability, or prior project delays. We will notify customers of scheduling changes as soon as possible.
Customers who need to cancel or reschedule a confirmed project should notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice may result in a rescheduling fee, as described in your written agreement.
Payment terms are specified in the written contract provided before work begins. A deposit may be required prior to scheduling. The remaining balance is due upon project completion unless otherwise agreed in writing.
Invoices unpaid beyond the due date stated in the agreement may be subject to late fees. We reserve the right to pursue collection of unpaid balances, including reasonable attorney fees and court costs where permitted by law.
Customers are responsible for providing accurate information about the property, including any known underground utilities, easements, property lines, or HOA restrictions. We are not liable for damage resulting from inaccurate information provided by the customer.
Customers must ensure clear access to the work area before the scheduled start date. Failure to provide access may result in rescheduling and additional fees.
We stand behind our workmanship. Any warranty on labor or materials is described in your written service agreement. Beyond what is stated in that agreement, services are provided "as is" and we make no additional warranties, express or implied, regarding fitness for a particular purpose or merchantability.
Manufacturer warranties on materials are governed by the manufacturer and are separate from any workmanship warranty we provide.
To the fullest extent permitted by applicable law, GC Pomona Fence Builder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or our Site, even if advised of the possibility of such damages.
Our total liability to any customer for any claim arising from a service engagement shall not exceed the total amount paid by that customer for the specific service giving rise to the claim.
